These Terms and Conditions govern your use of portuguesesnomundo.online and the associations' portal (together, the "Service"), operated by Cyber Planet Inc., a company incorporated in Ontario, Canada ("we", "us"). By using the Service you accept these terms. If you do not agree, do not use the Service.
1. What the Service is
The Service allows (a) anyone to browse, without an account, events and associations of the Portuguese community published on the platform; and (b) associations, clubs and organizations to subscribe to a plan to publish and manage their events.
We are an information intermediary. We do not organize the events, we do not sell tickets and we are not a party to the relationship between associations and the public. Registrations, tickets and event payments are handled directly by the organizing association.
2. Visitors
- Browsing the public site is free and needs no account.
- Event information is supplied by associations. We try to correct mistakes but do not guarantee it is complete, current or accurate. Always confirm details (date, time, place, price) with the organizer.
- You can report wrong or abusive information using the email on the Contact page.
3. Association accounts
- Application and approval. Each organization applies and is reviewed by us. We may approve, decline or ask for more information.
- Authority. The person applying declares they are authorized to represent the organization and binds it to these terms.
- Account security. You are responsible for keeping your password safe and for everything done in your account. We recommend two-step verification. Tell us immediately if you suspect unauthorized access.
- Accurate information. Organization and event details must be true and kept up to date.
4. Plans, free trial and payment
- Current plans and prices are on the Plans page. Prices are in Canadian dollars (CAD) and exclude applicable taxes (for example GST/HST or VAT), which are added where due.
- 7-day free trial. After your application is approved, a payment card is requested to start the trial. You are not charged during the trial. At the end of the 7 days the subscription automatically becomes paid and your card is charged every month, unless you cancel before then.
- Renewal. The subscription renews automatically every month until cancelled.
- Cancellation. You can cancel at any time in the subscription management area. Cancellation takes effect at the end of the period already paid; you keep access until then. We do not refund partly used periods, except where the law requires or where we choose to as a courtesy.
- Failed payment. If a payment fails we will retry and notify you by email. If it is not resolved within a short period (currently 7 days), the account is suspended and your events stop being shown publicly until payment is resolved. We do not delete your data because of this.
- Price changes. We may change prices and plans with at least 30 days' notice; the change applies from the next renewal. You may cancel if you disagree.
- Payments are processed by an external payment provider (currently Stripe). We do not store your full card details.
- We may grant free or promotional access, for a limited time or not, and withdraw it on the terms we indicate.
5. Content published by associations
By publishing content (text, images, logos, event information), the association:
- declares it has the necessary rights in that content (including images, music, logos and trademarks) and may authorize its use;
- grants us a non-exclusive, royalty-free, worldwide licence to store, display, adapt the format of (for example resize images) and distribute that content in the Service, newsletters and calendars while the content is published;
- keeps all rights it already had in the content.
6. Rules of use
You must not use the Service to:
- publish content that is illegal, misleading, defamatory, discriminatory, that incites hatred or violence, or that infringes third-party rights;
- publish fake events, abusive duplicates or events unrelated to the community the Service is for;
- send unsolicited communications (spam) or use lists of people without the consent required by law;
- try to access other people's accounts or data, bypass security measures, scrape data in bulk or overload the Service;
- impersonate another organization or person.
We may hide or remove content, suspend or block accounts and decline applications if these terms are breached or where needed to protect others or the Service. Where possible we will notify you and give the reason; in serious or urgent cases we may act without prior notice.
7. Artificial intelligence features
Some features (for example text or image suggestions) may use artificial intelligence services. Results are suggestions: the association must review them before publishing and is responsible for what it publishes. AI features have usage limits set by plan.
8. Intellectual property
The Service, the name "Portugueses no Mundo", the logo, design and software belong to Cyber Planet Inc. or its licensors. You may not copy or use them without written permission, other than normal use of the Service.
9. Availability and changes to the Service
We work to keep the Service available but do not guarantee uninterrupted or error-free operation. We may change, suspend or discontinue features. Some features described in the plans are being rolled out progressively.
10. Limitation of liability
To the maximum extent permitted by applicable law: (a) the Service is provided "as is"; (b) we are not responsible for events, for the conduct of associations or visitors, or for indirect loss, loss of profit or loss of data; and (c) our total liability to an association for any cause connected with the Service is limited to the amount that association paid in the 12 months before the event giving rise to the claim. Nothing in these terms excludes rights that the law does not allow to be excluded (for example consumer rights) or liability for wilful misconduct or gross negligence.
11. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or end access under section 6 or if an account has been inactive for a long time. After termination we may keep data for as long as the law requires or as needed to defend rights, as explained in the Privacy Policy.
12. Changes to these terms
We may update these terms. For material changes we will notify associations by email with reasonable notice. Continued use after the effective date means acceptance.
13. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. Disputes will be submitted to the competent courts of Ontario, without prejudice to consumer rights that, under mandatory law of your country of residence, cannot be waived.
